The WMATA Compact, which was approved by the Virginia General Assembly as well as Congress, gives the Northern Virginia Transportation Commission the right to appoint Virginia's delegates to the Metro Board. This makes sense because Virginia's contribution to Metro comes from special taxes on just Northern Virginia. McDonnell has never worked to fund Metro out of Virginia's general funds and opposes increasing taxes (including the gasoline tax) to adequately fund Virginia's transportation needs.

If McDonnell worked to adequately fund transportation on a state-wide basis, he might have a reasonable claim to a "Virginia seat" on the Metro Board, but he does not stand a chance of getting his seat through either the Democratic Virginia State Senate or the Democratic U.S. Senate.
